Shepard Fairey, who’s solo exhibit Supply and Demand is on display at the ICA, is in the middle of an ongoing legal battle with the Assoicated Press over creative use of one of their photographs. He was soon after arrested for vandalism.
Mannie Garcia, who shot the original photograph, is not in support of the AP’s claim of copyright infringement. He even questions the AP’s claim that it owns the copyright. Fair use of another’s work is allowed if the new work is said to be transformational. Decide for yourself; is has Fairey transformed Garcia’s original photograph?
Fairey has sparked the debate over public property, the line between vandalism and art, fair use, and the political influence of art.
